GENERAL CONDITIONS OF SALE
Payment is due immediately after the sale. All the property is sold in the condition in which it is offered for sale. No claim can be accepted after the fall of the hammer. All prospective buyers shall have the opportunity to inspect each lot for sale during the pre-sale exhibition in order to satisfy themselves as to characteristics, size, colours, repairs or restoration. Any possible modifications in the conditions of sale or in the descriptions of the catalog will be announced verbally during the sale and noted on the official report. The successful purchaser will be the highest bidder and will be obliged to give his or her name and address. In case of contesting at the time of awarding, that is if two or more bidders simultaneously carried an equivalent bid, either aloud, or by sign and demand at the same time this object after the pronouncement of the "awarded/adjugé" word, the aforementioned object will immediately be handed in auction to the proposed price by the bidders and the public will be allowed to bid again.
Regarding second-hand firearms, hunting firearms, sporting firearms, and ammunition are sold as is, without any warranty as to their operation from either the auction house or the expert. As the firearms cannot be tested, neither the auction house nor the expert guarantees their functionality. All firearms must be inspected by a qualified gunsmith prior to any use. Regarding the reassembly of firearms by purchasers, no claims may be made against the auction house or the expert in the event of missing parts or accidents.
Special Conditions for the Purchase of Category C Firearms Subject to Declaration
- A valid form of identification is required. In addition, pursuant to the Decree of 30 July 2013:
- A valid hunting license for the current year; or
- A valid sport shooting license.
Article 43 of the Decree of 30 July 2013
The acquisition by adults of Category C firearms and their components is subject to the presentation of a hunting license issued in France or abroad, or any equivalent foreign hunting permit, together with proof of validation for the current year, or a valid sport shooting license.
For the acquisition of a Category C firearm, presentation of one of the documents referred to above replaces the medical certificate required under Article L.312-6 of the French Internal Security Code.
Article 44 of the Decree of 30 July 2013
Where the acquisition is made for the purpose of transfer to another Member State of the European Union or export to a third country, the acquisition of firearms, ammunition, and their components listed under items 1°, 2°, 3°, and 8° of Category C is not subject to the presentation to the seller of a hunting license issued in France or abroad, or any of the documents provided for under Article L.423-21 of the French Environmental Code.
Such acquisition is subject to the presentation of an export authorization where required. The acquisition of firearms under item 3° of Category C, as well as firearms and ammunition under item 2° of Category D, is not subject to the presentation of any of the documents referred to in the first paragraph.
Where the acquisition is made by an approved sport shooting association or by an operator of a fairground shooting range, the acquisition of Category C firearms, ammunition, or their components is not subject to the presentation of a hunting license issued in France or abroad, or any of the documents provided for under Article L.423-21 of the French Environmental Code.
The successful bidder must also have opened a SIA (Firearms Information System) account beforehand.
Special Conditions for the Purchase of Category B Firearms Subject to Authorization
The following documents are required:
- A copy of a valid FFTir (French Shooting Federation) license;
- A valid proof of identity (document bearing the applicant’s photograph);
- Proof of residence or business address (e.g., electricity bill, rent receipt less than three months old, etc.);
- An active SIA account and confirmation that the applicant is not registered in the FINIADA database.
These documents must be sent to contact@briscadieu-bordeaux.com when registering. ANY MISSING DOCUMENT WILL RESULT IN THE CANCELLATION OF THE LIVE BIDDING REGISTRATION.
IMPORTANT
It is prohibited to sell firearms, ammunition, or firearm components to minors.
- Only a person exercising parental authority may acquire firearms, ammunition, or firearm components on behalf of a minor.
It is prohibited to sell firearms, ammunition, or firearm components to adults who do not present the required documentation authorizing acquisition.
- Sport shooters must present either:
- A prefectural authorization (Categories A and B); or
- A valid shooting license (Category C).
- Hunters must present proof of lawful possession (hunting license and current annual validation).
- Collectors must present a collector’s card.
It is prohibited to sell firearms, ammunition, or firearm components to any person registered in the French national database of persons prohibited from acquiring and possessing firearms (FINIADA).
ANY SUSPICIOUS REQUEST FOR ACQUISITION MAY RESULT IN THE REFUSAL OF THE SALE.
Note: Firearms will be stored securely in an alarmed and monitored facility. Cartridges and ammunition will be sold by description only.
BUYER’S PREMIUM AND PAYMENT
In addition to the hammer price, purchasers shall pay the following fees and taxes per lot:
- 25% incl. VAT (20.83% excl. VAT) for voluntary sales;
- 14.28% incl. VAT (11.90% excl. VAT) for judicial sales.
Additional LIVE bidding fees (applicable to both voluntary and judicial sale lots):
- 1.8% incl. VAT on interencheres.com;
- 1.8% incl. VAT on drouot.com.
Payment is due immediately after the sale:
- Bank wire transfer in Euros (BRISCADIEU’s account number on the invoice).
- Credit card: Visa, MasterCard, China Unionpay, on the payment page of our website
- Cash in Euros: for French resident (private or professionals) to an equal or lower amount of € 1 000 per sale (but to an amount of € 15 000 for a non-French resident), bayer’s premium included.
Please note that purchases can only be collected after payment in full.
All auction sale invoices remaining unpaid after BRISCADIEU BORDEAUX and/or Me Antoine BRISCADIEU or subject to delays in payment may be added to the TEMIS File.
NON-PAYMENT - AUCTION ACCESS RESTRICTION FILE (TEMIS)
All auction sales invoices remaining unpaid after BRISCADIEU BORDEAUX and/or Me ANTOINE BRISCADIEU or subject to delays in payment may be added to the Auction Access Restriction File ("TEMIS File") maintained by Commissaires-Priseurs Multimédia (CPM), public limited company with executive board, with registered office at 37 Rue de Châteaudun, 75009 Paris, listed on the Paris Trade and Companies Register under number 437 868 425. The TEMIS File may be viewed by all France-based auctioneers who subscribe to this service. The list TEMIS Service subscribers is available to view at , in the dropdown menu "Acheter aux enchères" (Buy at auctions), under "Les commissaires-priseurs" (Auctioneers). Bidders listed on the TEMIS File may face restrictions on their bidding activity at auctions operated by auctioneers with a Professional Subscription to the TEMIS service. In such cases, this shall also result in temporary suspension of access to the live service, operated by CPM, in accordance with the general terms of use for this platform. Where a bidder is listed on the TEMIS File, BRISCADIEU BORDEAUX and/or Me ANTOINE BRISCADIEU may make access to auctions contingent on the use of payment methods or specific guarantees, or it may prevent the Bidder from participating in auctions for which such guarantees cannot be provided. Bidders can find out if they are listed on the TEMIS File, contest their TEMIS File listing, or exercise their rights of access, rectification, erasure, restriction or objection under applicable data protection legislation, by submitting a request in writing accompanied by proof of identity in the form of a copy of a relevant identity document: - For listings added by BRISCADIEU BORDEAUX BRISCADIEU BORDEAUX and/or Me ANTOINE BRISCADIEU: by post to BRISCADIEU BORDEAUX 12-14, rue Peyronnet 33800 Bordeaux, - For listings added by other Professional Subscribers: by post to CPM, 37 Rue de Châteaudun, 75009, or by email to contact@temis.auction. ABSENTEE BIDS, BIDDING BY TELEPHONE, AND LIVE BIDS
If you cannot attend the auction, we will be pleased to execute written bids on your behalf.
This service is free and confidential. BRISCADIEU BORDEAUX and/or Me ANTOINE BRISCADIEU cannot be held liable for errors or omissions of any kind in the handling of orders.
A bidding form can be found at the end of the catalogue. Please fill this form and attach bank account details and a copy of your identity card or passport. BRISCADIEU BORDEAUX and/or Me ANTOINE BRISCADIEU reserve the right not to record an absentee bid if it is not complete or if we consider that the client does not offer all the guarantees for the deals; without any possible recourse. Please ensure that we receive your written bids the day before the auction, 8 pm.

DELIVERY, TRANSPORT & STORAGE FEES
Once the hammer falls, the new buyer becomes the owner and so becomes responsible for the lot. We do not assume any liability for loss or damage to items which may occur after the hammer falls. Please note that purchases can only be collected after payment in full.
Small purchases are held on free deposit at the auction house for 12 days. In addition, storage costs will be charged: Object, table or Wine box: 20 €/month.
We do not proceed to any shipping.
For people who bought by telephone, via absentee bid or live, items can be sent : for this service, please contact the company mentioned which will be in charge of the packaging and the shipment.
Buyers are invited to organize themselves the shipping if they don’t agree with these conditions.
